Colucci Norman Partner Testifies on Beacon Hill Regarding
Restrictive Employment Covenants
On Wednesday, October 7, 2009, firm partner, Andrew P. Botti, testified on Beacon Hill before the Joint Committee on Labor and Workforce Development of the Massachusetts Legislature on the provisions of a pending non-compete bill (H 1799), “An Act Relative to Non-Compete Agreements.” The original proposed bill (H.1794), “An Act to prohibit restrictive employment covenants,” started as a proposed complete ban on employment related restrictive covenants throughout the Commonwealth.
Input from the business community and legal practitioners like Andrew appears to have resulted in a more balanced approach to the issue of restrictive covenants. Andrew explained the need for such restrictions, and their import to smaller business owners and operators in particular, many of whom have put all their assets on the line to start and nurture new business ventures.
